Republican State Senators refuse to pass South Carolina's pro-life bill to end "legalized" abortion

Statement by Steve Lefemine, pro-life missionary, director, Columbia Christians for Life:

The Lord Jesus Christ is Pro-Life. He is the Creator of life. The Bible says that He is King of kings and Lord of lords, and that includes His Kingship and Lordship over the General Assembly of South Carolina. The Bible says that the LORD “is the governor among the nations,” and that He “is the King of all the earth.” His Kingship includes authority over the state of South Carolina. God has given his command to mankind, “Thou shalt not kill (murder).” Yet South Carolina has been in rebellion against God, murdering over 310,000 pre-birth children since 1973. Today SC murders about 6500 children a year; that’s 125 per week, primarily in the three cities with abortion centers: Charleston murders about 55 per week; Greenville, 45 per week; and Columbia, 25 per week. Our entire state is polluted with the innocent blood of murdered children, and the shedding of their blood is protected by the state.

The Right to Life Act of South Carolina is SC’s only bill to end “legalized” abortion. It could also be called SC’s “Personhood for the Unborn” bill. The bill recognizes the legal “personhood” of all pre-birth human beings, at fertilization. It would ban all “legalized” child-murder-by-abortion, because the SC State Constitution, in Article I., Section 3., already protects legal “persons” from being deprived of life without due process of law, and in the bill’s original form (i.e., without any so-called “exceptions”), would inarguably place all pre-birth human beings in the same protected status. In the text of the Roe v. Wade decision 33 years ago, the Supreme Court said that if personhood for the “fetus” [unborn child] was established, then the case for abortion would collapse.

With the 2006 session of the Legislature scheduled to end on June 1, unless the SC Senate takes action on the version that passed the House in 2005 (H.3213), the bill will die, and the 6,500+ children murdered every year in SC by surgical abortion will have to wait until the 2007 session for new legislation to pass, at the earliest.

Incredibly, even though H.3213 passed the House on Second Reading on April 13, 2005 by a vote of 95 Yeas to 18 Nays (albeit with a fatal flaw rape exception amendment that must be removed), the bill has gone nowhere in the Senate after two public hearings in May 2005 before the Senate Judiciary Subcommittee chaired by Senator Jim Ritchie (R-Spartanburg). H.3213 has sat in this Subcommittee for over one year, even though Republicans outnumber Democrats 4 to 1 ! This includes Senator Glenn McConnell (R-Charleston), chairman of the full Judiciary Committee. With just days left in the 2006 session, unless something changes, and quickly, the bill will die June 1.

The RTL Act of SC was first filed in 1998, by Rep. Terry Haskins in the House, and by Senator Mike Fair in the Senate. It has been an active bill in the House every year since, the current sponsor being Rep. Ralph Davenport. The Republicans have been the majority in control of the House consistently now for 12 years beginning in 1995. House Republican leaders had opposed the bill for years, or not supported it. Then, in early 2005, the SC Attorney General issued a legal opinion that the RTL Act of SC was constitutional on its face, though if applied to abortion, would have to be adjudicated. The bill finally passed the House in April 2005, and went over to the Senate. If the Senate refuses to take action to pass the Right to Life Act of SC by June 1, the responsibility must rightly be placed at the feet of those Senators who are members of the political party that is now in power, the REPUBLICANS :
  • The Republicans are the majority in the SC House (74 Republicans to 50 Democrats).
  • The Republicans are the majority in the SC Senate (26 Republicans to 20 Democrats).
  • The Republicans in SC currently occupy the Governor's office, the Lt. Governor's office, and the Att. Gen.'s office.

It is the Republicans who are the majority in the State Senate who are responsible for refusing to take action to pass the Right to Life Act of SC, and who will therefore be responsible for prolonging child-killing in our state.

The 2004 Republican Party National Platform states, “As a country, we must keep our pledge to the first guarantee of the Declaration of Independence. That is why we say the unborn child has a fundamental right to life which cannot be infringed… Our purpose is to have legislative and judicial protection of that right against those who perform abortions.” It’s well past due the time for Republicans to back up these words with legislative action.

To the 19 Republican SC State Senators who are not co-sponsors of the Senate version of the RTL Act, S.111, we ask, why aren’t you a co-sponsor ? Please pass the Right to Life Act before the session ends on June 1st. Now to those of you here, attending this news conference, I invite you to please help by lobbying these Senators upstairs. Thank you for coming, if you can stay to lobby the Senators, please gather here behind the podium at the conclusion.

The Right to Life Act of South Carolina could also be called SC’s “Personhood for the Unborn” bill.

The bill recognizes the legal “personhood” of all pre-birth human beings, at fertilization. It would ban all “legalized” child-murder-by-abortion, because the SC State Constitution, in Article I., Section 3., already protects legal “persons” from being deprived of life without due process of law, and S.111 / H.3213, in the bills’ original forms (i.e., without any so-called “exceptions”), would inarguably place all pre-birth human beings in the same protected status. Attention South Carolina pro-lifers !

Please help distribute the flyer below (one-page flyer version at the attachment) around South Carolina today, to family, friends, people at church, and the public.

There are just 14 days remaining in the regular session of the SC Legislature for 2006; it ends June 1 (the same day as the beginning of hurrican season !).

The Right to Life Act of SC passed the SC House last year in April 2005 (albeit with a fatal flaw rape exception amendment that needs to be removed), but has now sat in the Republican-majority SC Senate, in a Senate Judiciary Subcommittee, for over one year. If nothing is done in the next two weeks, the bill dies June 1, and the process would have to start all over again for the 2007 session.

Meanwhile, South Carolina's three abortion centers (in Greenville, Columbia, and Charleston) continue to murder 6,500+ (2004 DHEC statistic) pre-born babies each year, by surgical abortion alone. Their shed innocent blood pollutes the land of the entire state of South Carolina (Numbers 35:33). The voice of their shed innocent blood cries out from the ground to (Genesis 4:10) to God. He hears their cry, and He will execute righteousness and judgment for all that are oppressed, including the 6,500+ killed in South Carolina each year (Psalm 103:6).

Less than one month in SC's 2006 session before RTL Act of SC dies !

The Right to Life Act of SC was first introduced in the SC House in 1998. It has been an active bill in the SC House every year since, with public hearings in 2001,2004, and 2005. It took 7 years to get the bill through the SC House in 2005, even though the Republicans have been in the majority in the SC House for 10 years since (and including) 1995. The current House version is H.3213.

The Right to Life Act of SC was first introduced in the SC Senate in 1998. It was not introduced again until 7 years later, in 2005. After H.3213 passed the SC House in April 2005, there were two public hearings on the Right to Life Act in the Senate Judiciary Subcommittee of Senator Jim Ritchie (R-Spartanburg) in May 2005. That is the last action that Senator Ritchie's Subcommittee has taken on the bill. The current Senate version is S.111.

Both H.3213 and S.111 are in Senator Ritchie's Subcommitee, where four of the five State Senators who can vote on the bill are Republicans. The other three Republicans beside Senator Ritchie are: Senator Luke Rankin (R-Conway), Senator Randy Scott (R-Summerville), and Senator Glenn McConnell(R-Charleston). Senator McConnell has a vote according to Senate rulesbecause he is the chairman of the full Senate Judiciary Committee.

The 2006 regular session of the SC Legislature is scheduled to end on June 1, 2006.

Incredibly, even though the SC House version (H.3213) of the Right to Life Act of SC passed the SC House on Second Reading (with 52 co-sponsors; 47 R's and 5 D's), on April 13, 2005 by a vote of 95 to 18 (albeit with a fatal flaw rape exception amendment that must be removed), the bill has gone nowhere in the SC Senate after two hearings in the Senate Judiciary Subcommittee chaired by Senator Jim Ritchie (R). It has now sat in Senator Ritchie's Subcommittee for over one year, and there are less than 30 days left in the 2006 session. If nothing changes, the bill will die June 1st, and the 6,500+ children murdered every year in South Carolina by surgical abortion, primarily at the state's three abortion centers in Greenville, Columbia, and Charleston, will have to wait until the 2007 session for new legislation to pass, at the earliest.

“We (supporters of limits) basically got together and decided abortion wouldn’t be an issue this year,” Sen. Mike Fair, R-Greenville, said of supporters of limiting abortion. “Had we known South Dakota would have done what they did, there would have been thoughtful consideration on testing the waters here, I assure you.”

The time is now to pass legislation to ban child-murder, not a year from now !

The South Carolina Senate has 46 members: 26 Republicans and 20 Democrats. There are five Senators who may vote on Senator Ritchie's Subcommittee; of the five, four of them are Republicans. So let us make no mistake about this. It is the party in power, the party in the majority, the Republicans, who are refusing to pass this bill, who are refusing to "establish justice" for the unborn, and protect these children who cannot speak for themselves.

Senator Ritchie's Subcommittee is part of the Senate Judiciary Committee, chaired by Senator Glenn McConnell, who may also, according to Senate rules, vote on Senator Ritchie's Subcommittee. Senator McConnell is one of the four Republicans on Senator Ritchie's Subcommittee that can vote on this bill. The other two are Senator Randy Scott and Senator Luke Rankin.

If something is to be done to protect the unborn this year instead of waiting until next year, there are only 27 days left in the session to act.

What can you do ? Call, write, or fax Republican Senators Mike Fair, Jim Ritchie, and Glenn McConnell as soon as possible. Ask them not to allow the bill to die, but instead to work for its passage, beginning with a vote in Senator Ritchie's Subcommittee, and then a vote in Senator McConnell's full Judiciary Committee, and then a vote on the floor of the full SC Senate (Senator McConnell, perhaps the most influential Senator in SC, is also President, Pro Tempore, of the full46-member SC Senate).

Call or fax Republican Governor Mark Sanford as soon as possible. Ask him to use his influence and his 'bully pulpit' as Governor (as he has done on other issues), to take action on this, his second most important duty as Governor, the prevention of the shedding of innocent blood in South Carolina. (His first duty a Governor is to acknowledge and honor the God of the Bible - Psalm 2).

Children in South Carolina continue to die at the rate of 125 per week, and waiting until 2007 while children are being murdered now is unacceptable !

During the state budget debate on the floor of the SC Senate o/a April 25, 2006, the Chairman of the Senate Finance Committee, Senator Hugh Leatherman (R) said:

“Hurricanes are inevitable. They’re coming. Look down in Louisiana. We need to get prepared for them. Suppose the hurricane comes. Whose hands is da’ blood goin’ to be on ? It’s goin’ to be on your hands and my hands. I’ll tell you that.”

Senator Leatherman was talking about the danger of cutting certain items from the state budget, including, specifically, items requested by the SC governor for hurricane/disaster preparedness. His point apparently was that if the money wasn’t allocated, the blood of any of those harmed as a result would be on the hands of members of the SC Senate for not allocating.

Beyond what Senator Leatherman meant by this statement, was God sending a further message of His own to the Senate of South Carolina ?

WHAT ABOUT THE BLOOD THAT IS ALREADY ON THE HANDS OF THE SENATE OF SOUTH CAROLINA FOR THE 310,000+ PRE-BORN CHILDREN THAT HAVE BEEN MURDERED PRIMARILY IN GREENVILLE, COLUMBIA, AND CHARLESTON SINCE ’73 ?

Will it take another Hurricane like Katrina, stronger than Hugo in 1989, to humble our SC Senate ? This same SC Senate that has “sat” on a bill to ban child-murder by abortion for over a year since it passed the SC House on April 14, 2005 ? The bill is called the “Right to Life Act of South Carolina” and the House version (H.3213) passed in 2005 (albeit with a fatal flaw rape exception amendment), but the Senate Judiciary (Chairman Senator Glenn McConnell (R)) Subcommittee of Senator Jim Ritchie (R) has refused to take a vote on the bill, or the unamended Senate companion bill (S.111). Four of the five Senators who can vote in Senator Ritchie’s Subcommittee are Republicans !!!

The SC Senate has a Republican majority, with 26 Republicans to 20 Democrats. The RTL Act is a bill to recognize the legal ‘personhood’ of all pre-birth human beings, at fertilization. This bill would ban all legalized child-murder-by-abortion, because the SC State Constitution, in Art. I., Sec. 3, already protects legal ‘persons’ from being deprived of life without due process.

Of the 26 Republicans in the SC Senate, only seven have signed on as co-sponsors of S.111:
