Public Hearing (5th since 2001) for SC Personhood Bill (H.3526) - Tuesday, February 2

With 52 SC House co-sponsors, the Right to Life Act of SC (SC Personhood Bill) is scheduled for a public hearing on Tuesday, February 2, in Room 516, Blatt Building, State House Complex (corner Pendleton and Assembly Streets), Columbia, South Carolina. The time is one hour after the House adjourns from its regular daily session, which begins at 12 noon. The estimated time of the Constitutional Laws Subcommittee hearing is therefore approx. 2:30 PM.

The Constitutional Laws Subcommittee (of the House Judiciary Committee) is chaired by Rep. Greg Delleney (REPUBLICAN-Chester). Despite having passed a closely similar bill out of his subcommittee in 2004 and 2005, Rep. Delleney did not pass the bill out of his subcommittee after a Feb. 2008 public hearing, at which the SC Attorney General, Henry McMaster spoke about his March 2005 Legal Opinion, which held: "It is our opinion that ... the Right to Life Act - is constitutional on its face" ... [ however ] "the statute could not be applied in the context of abortion to deny the federal constitutional right to privacy."

The SC Personhood Bill has not been passed out of the Constitutional Laws Subcommittee, chaired by REPUBLICAN Representative Greg Delleney (R-Chester, SC), since the 2005-2006 Session. In 2005, the SC Personhood bill passed the Constitutional Laws Subcommittee, and then it passed the full Judiciary Committee (REPUBLICAN Chairman Jim Harrison (R-Columbia, SC), with no amendments. Then the bill passed the full SC House, but not before it was amended with a fatal flaw amendment on the House floor. Since then, in 2007, 2008, and 2009, the House version of the SC Personhood bill has been held captive in REPUBLICAN Rep. Greg Delleney's Constitutional Laws Subcommittee.

The Right to Life Act of South Carolina (South Carolina Personhood Bill) is constitutional on its face, however if applied to "abortion," would need to be adjudicated (tried in court). [ As Mississippi Lt. Governor Phil Bryant (R) said about the Mississippi Personhood Constitutional Amendment he is endorsing, it is a foregone conclusion that personhood legislation would face a legal challenge in court. ]

Mississippi Lt. Governor (R) leading in ballot initiative drive for Mississippi Personhood Constitutional Amendment

After the dutiful honoring and fear of God (2 Samuel 23:3, Psalm 2, Romans 13:1-4), the FIRST Duty of civil magistrates is to prevent the shedding of innocent blood in their jurisdiction. Mississippi Lt. Governor Phil Bryant is to be commended for having the vision, courage, and integrity to provide leadership in this historic petition drive in Mississippi as it approaches the February 13th deadline of obtaining 89,000+ valid petition signatures so that the Mississippi Personhood Constitutional Amendment can be placed on the Mississippi ballot for a citizen vote.
