SC Senate Journal - March 30, 2010 - Remarks of SC Senator Mike Rose (R-Dorchester/Charleston)

www.scstatehouse.gov/sess118_2009-2010/sj10/20100330.htm

Excerpts:

"There is a trend in the last few years in the U.S. Supreme Court. I've got three cases here in which the U.S. Supreme Court upheld state laws that conflicted with laws of the federal government."

"Today we have a new theory. We have a new plan of action endorsed by the U.S. Supreme Court steadily growing, case by case, to carve out areas in which the states can preserve their own rights. And we should take advantage of this."

"We need to pass more legislation that preserves fundamental rights for the citizens of our states; ... "

"When you hear lawyers and their conflicting theories -- I think it's been pretty much one-sided what's been said here today -- remember there is authority that allows states to pass laws that give our citizens more protections than does the federal government, and only by testing new laws, step by step, are we going to see what the outer limits of those state protections are. I think we ought to proactively establish and litigate what are our citizens' rights. We ought to be -- I wouldn't use the word ashamed -- but how can we justify -- how can we say when our forefathers sacrificed so much to stand up to federal authority, that we're not now going to take advantage of this legal way of doing the same, just because it might cost a lot of attorney fees or be a lot of trouble?"

Republican Leadership in SC Senate Blocking Personhood for Pre-born Bill - S.450

LETTER TO THE EDITOR

March 26, 2010

"Republican Leadership in SC Senate Blocking Personhood for Pre-born Bill - S.450"

Columbia [ SC State House ] - On Thursday (March 25) Senator Jake Knotts (R - W.Columbia / Lexington) said "No" to Johnny Gardner's (dir., Voice of the Unborn) face-to-face request for a public hearing for S.450 ! Gardner asked Republican Senator Knotts if Knotts would consider letting us have a hearing on Senator Bright's bill (the SC Personhood Bill) ? Senator Knotts said "No".

Time is running out in the 2009-2010 legislative session to pass S.450, the SC Personhood Bill, to END "abortion". We have perhaps 2-3 weeks to get the bill out of REPUBLICAN Senator Jake Knotts' subcommittee. Even though we have 23 Senate co-sponsors ( 1/2 the entire SC Senate ), and even though three out of six members on Jake Knotts' subcommittee itself are co-sponsors, Knotts is refusing to even grant a public hearing !!!

Please call Senator Jake Knotts now at (803) 755-6253 (H) and (803) 212-6350 (O) and ask him WHY will he not even grant a public hearing for S.450 when 50% of the entire SC Senate is co-sponsoring the bill, and 50% of his own Judiciary Subcommittee is co-sponsoring the bill ? [ Knotts was appointed as chairman of this Judiciary subcommittee by Senator Glenn McConnell (R-Charleston), Judiciary Committee chairman, who is NOT a co-sponsor of S.450. Republican Senator Glenn McConnell is also President Pro Tempore of the SC Senate. ]

Ask REPUBLICAN Senator Jake Knotts to reconsider his refusal to grant a public hearing, to stop trying to block this pro-life / anti-abortion legislation designed to recognize pre-birth human beings as "persons", and to schedule a hearing for S.450 as soon as possible !!! Additional information is available on the home page of http://www.christianlifeandliberty.net/

Also call Republican Judiciary Committee chairman and SC Senate Pro Tempore Glenn McConnell at (843) 571-3921 (H) and (803) 212-6610 (O) and (843) 747-7554 (Bus.), and ask him why his appointed subcommittee chairman, Senator Jake Knotts, is refusing to even grant a hearing for S.450 ? Request Sen. McConnell to ask Sen. Knotts to schedule a public hearing for S.450.

God is judging South Carolina for over 300,000 [ surgical ] "abortions" - Read Psalm 106:37-44, KJB. When we are concerned enough about the right to life of the innocent pre-born to cry out for JUSTICE for THEM [ NOT just "regulation" of their murder ], THEN God will deliver US from the wicked rulers and their encroaching statist tyranny which has already begun to oppress us. ESTABLISH JUSTICE for the pre-born - PASS S.450 - the SC Personhood Bill.

Republican Leadership of SC General Assembly Refuses to Pass Personhood for Pre-born

LETTER TO THE EDITOR / OP-ED

March 15, 2010 / Revised March 27, 2010

"Republican Leadership of SC General Assembly Refuses to Pass Personhood for Pre-born"

For TWELVE YEARS now (beginning in 1998), "Personhood" legislation has continually, every session, been filed in the SC Legislature, without being passed into law. As we approach the 2010 Primaries and General Election, some Christian and constitutionalist voters are taking a harder look at whether or not certain Republican officeholders are actually "RINO's". The question should be asked, "Who are the SC House and Senate members blocking passage of legislation recognizing the legal PERSONHOOD of pre-born human beings from the moment of fertilization ?"

Republicans have continually been in the Majority in the SC House since Jan. 1995, and Republicans have continually been in the Majority in the SC Senate since Jan. 2001, and yet this bill has only passed the SC House once in April 2005 (albeit with a fatal flaw rape exception), before being sent to the Senate, and dying after two public hearings. The Creator-endowed unalienable right to life is held to be the first of the "self-evident" "truths" of the 1776 Declaration of Independence, which is part of the organic law of the United States Code. There are presently 73 Republicans and 51 Democrats in the SC House, giving the supposedly "pro-life" party a plus 22-vote advantage. In the SC Senate, there are presently 27 Republicans and 19 Democrats, giving the supposedly "pro-life" party a plus eight-vote advantage. The SC Personhood Bills (H.3526 and S.450 at www.scstatehouse.gov) are being held up by the Republican House and Senate Leadership. The House version (H.3526) presently has 54 co-sponsors (including five Democrats), however neither the Constitutional Laws Subcommittee chairman (Rep. Greg Delleney, R-Chester), nor the Judiciary Committee chairman (Rep. Jim Harrison, R-Columbia), nor the House Speaker (Rep. Bobby Harrell, R-Charleston) are co-sponsors of the bill. The Senate version (S.450) presently has 23 co-sponsors (including four Democrats), which is 50% of the entire SC Senate, however neither the Judiciary Subcommittee chairman (Sen. Jake Knotts, R-West Columbia / Lexington), nor the Judiciary Comm. chairman (Sen. Glenn McConnell, R - Charleston), nor the Senate President Pro-Tem (also Sen. Glenn McConnell, R-Charleston), are co-sponsors of the bill. Last month (Feb. 4), a public hearing was held for H.3526, however no vote was taken; just as no vote was taken in a Feb. 2008 public hearing.

It is the REPUBLICAN LEADERSHIP in the SC House and SC Senate which is protecting the ongoing slaughter of the pre-born, approx. 7,000 pre-birth children murdered in their mothers' wombs each year in South Carolina, by surgical abortion alone. It is the shed blood of innocent children which is crying to God from the ground for JUSTICE (not just incremental "regulation") which God Himself is hearing, and repaying, with Divine Judgment, in turning South Carolina and America over "into the hand of the heathen", such that "they that [hate us rule] over [us]", and "[our] enemies also [oppress us]". Read Psalm 106:37-44, KJB. When we care enough to cry out for JUSTICE for the Pre-born, THEN God will deliver us.

Ballot push seeks to challenge Roe v. Wade

Molly Parker • mparker2@jackson.gannett.com • February 17, 2010

[ emphasis added ]

Les Riley stood on the steps outside the secretary of state's office Tuesday with his 22-month-old adopted son in his arms and told a small, enthusiastic crowd that "the state of Mississippi is fixin' to educate the Supreme Court" on the rights of the unborn.

Declaring this a mission for God, Riley and his supporters delivered 105,167 certified signatures to get a constitutional amendment on the 2011 ballot asking voters to define life as beginning at "the moment of fertilization."

If the signatures add up in an official count, Riley's group will claim the third constitutional amendment to ever make a Mississippi ballot.

Riley, a father of 10 from Pontotoc, called the petition drive a "direct challenge to Roe v. Wade."

Riley's goal is to overturn the 37-year-old decision - among the most controversial rulings in the court's history - that even conservative [ sic ] Supreme Court justices have left intact through the years.

"Father, you don't need the Supreme Court; you don't need the Legislature. You need people who love Christ," Riley said. [ prayed ]

As he led the group in prayer, a small girl clutched her baby doll and other attendees bowed their heads over posters - some of which depicted graphic images of aborted fetuses. [ babies ]

Riley's baby, Josiah, nuzzled his head against dad's shoulder.

The nonprofit Personhood Mississippi is the 26th group to attempt to get an initiative on the ballot, Secretary of State Delbert Hosemann said.

Of the 25 past attempts, only two made it to the ballot. Both were related to term limits for lawmakers and both failed to gain voter support, Hosemann said.

Hosemann, a Republican, joined the rally on the front steps of his office before heading inside to officially collect the signatures, delivered in several cardboard boxes.

"Out here," Hosemann said, "I'm just another person that signed this petition."

Numerous other Republican politicians emerged from the Capitol across the street to join the rally.

Lt. Gov. Phil Bryant said when he first ran for public office he prayed for the chance to make a difference - beyond debating budgets and hunting laws.

"I want to end abortion in the state of Mississippi," Bryant said.

Bryant, a likely gubernatorial candidate in 2011, said his support of the ballot initiative has nothing to do with politics.

"That's the silliest thing I've ever heard of," he said.

In what promises to be a heated election year, the initiative is likely to bring out conservative voters if it makes the 2011 ballot, as is another one that seeks to implement a voter ID law in the state.

Republican-led efforts to require a form of identification at the voting booth failed last year in the Legislature.

Last week, supporters delivered enough petition signatures to take the question to the voters.

Voter ID would mark the fourth question to make a Mississippi ballot if the signatures are verified.

The personhood initiative would be third and voter ID second because the process for the anti-abortion amendment began first.

Initiatives similar to Personhood Mississippi's that seek to define life at conception could be on ballots in other states as well.

But Richard Miller of Jackson believes it has the best chance of passing in Mississippi.

"The process could start in this room right here," Miller said of reversing Roe v. Wade.

Earlier this month, Personhood Mississippi filed a federal lawsuit against Hosemann and Attorney General Jim Hood seeking more time for circuit clerks to verify several thousand outstanding signatures.

There is a discrepancy in the interpretation of the law as to whether the group has one year to collect signatures, or one year to turn them in.

The lawsuit seeks to clarify a 1996 Mississippi attorney general's opinion that says the one-year turnaround time also includes the names on the petition being certified by circuit clerks around the state.

Hosemann said that case will be moot if Personhood Mississippi turned in enough signatures Tuesday.

Getting an initiative on the ballot requires a minimum of 89,285 signatures, with at least 17,857 coming from each of the old five congressional districts that existed in the year 2000.

Personhood Mississippi to Hold Press Conference and Victory Rally with Lieutenant Gov. Phil Bryant.

JACKSON / Christian Newswire / February 15 – Personhood Mississippi is holding a press conference to announce the number of signatures collected for the personhood amendment, followed by a victory rally to submit the gathered signatures. With the help of over 2,000 volunteers and nearly 1,000 churches, Personhood Mississippi is expected to present well over the number of 89,285 required by the Secretary of State’s Office.

“February 16 will be an historic day for the state of Mississippi,” affirmed Personhood Amendment sponsor Les Riley. “The people of Mississippi have made a clear statement with their signatures – it is time that all humans are valued as people, not as property.”

Personhood Mississippi encountered a complication when it appeared that the County Circuit Clerk was discounting valid signatures due to time constraints, necessitating a lawsuit to ensure that every voter’s signature was certified. The Personhood Amendment signature campaign is awaiting a ruling on the first phase of the legal challenge, yet due to a State of Emergency in Mississippi and time needed to review the case, Personhood Mississippi is allowed to submit the signatures Tuesday, February 16.
Lieutenant Governor Phil Bryant, who assisted the campaign, will be in attendance as Personhood Mississippi submits signatures to the Secretary of State’s Office.

ONLY PRO-PERSONHOOD CANDIDATES IN 2010 - in Primaries, and in the November General Election:

This is the standard by which candidates for state and federal office should be judged as we enter the 2010 Election season:

ONLY CANDIDATES WHO PUBLICLY ENDORSE LEGAL PERSONHOOD FOR THE PRE-BORN SHOULD BE SUPPORTED.

"PERSONHOOD" is the KEY to ENDING Child-Murder-by-"Abortion" - listen to the words of the U.S. Supreme Court Justices themselves in the actual [ second ] Oral Arguments [ October 11, 1972 ] of the Roe v. Wade case (1973):

CHILD-MURDER BY "ABORTION" CAN BE ENDED BY RECOGNIZING THE PERSONHOOD OF PRE-BIRTH HUMAN BEINGS, AT FERTILIZATION, WITHOUT EXCEPTIONS.

Colorado Personhood Constitutional Amendment campaign submits petitions to Secretary of State

Personhood Colorado turns in over 3,700 more signatures than the 76,000+ required –
"All signatures are pending validation by the Colorado Secretary of State’s office."

If successful in achieving the required 76,047 validated signatures for the Nov. 2010 ballot, this will be the second time that Colorado has had a Personhood Constitutional Amendment on the ballot. In Nov. 2008, a personhood amendment was approved by over 26% of Colorado voters, totalling well over half a million (over 585,000).

Public Hearing for SC Personhood Bill - Columbia, SC - February 4, 2010

REPUBLICAN Con Laws Subcomm. Chairman refused to pass out SC Personhood Bill, until his two incremental, "abortion"/murder regulation bills pass the SC Senate.

God's Requirement for Murder is JUSTICE, not Regulation !

After Rep. Greg Delleney (Con Laws Chairman) announced the meeting was adjourned at the end (10 AM),
this exchange followed:

Mr. Johnny Gardner, dir., Voice of the Unborn: "Will the rest of us get to be heard later ?"
[ most citizens signed up to speak were not heard ]

Rep. Greg Delleney: "Not this year. ... Not unless my two [ CCL: incremental ] bills get passed the Senate."
